Terms of Service

1. Acceptance of Terms

Welcome to Pristine Clean ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at pristineclean.ca (the "Service") operated by Pristine Clean and your relationship with Pristine Clean as a customer of our cleaning services.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service or use our cleaning services.

2. Services Description

Pristine Clean provides residential and commercial cleaning services across Canada. Our services include, but are not limited to, regular scheduled cleaning, deep cleaning, eco-friendly cleaning, move-in/move-out cleaning, post-construction cleanup, and specialized cleaning services.

The specific details, scope, and cost of services will be agreed upon between Pristine Clean and the client prior to the commencement of any cleaning services. This may be in the form of a written quote, estimate, or formal contract.

3. Scheduling and Cancellations

3.1 Scheduling

Services are scheduled based on mutual agreement between Pristine Clean and the client. We make every effort to accommodate preferred cleaning dates and times but cannot guarantee specific time slots.

3.2 Cancellations and Rescheduling

Clients wishing to cancel or reschedule a cleaning appointment must notify Pristine Clean at least 48 hours in advance. Cancellations or rescheduling requests made with less than 48 hours' notice may be subject to a cancellation fee of up to 50% of the scheduled service cost.

3.3 No-Shows

If a client is not present at the scheduled time when in-person presence is required and has not made prior arrangements with us, we will attempt to contact the client. If we cannot reach the client or gain access to the premises, this will be treated as a late cancellation and may result in a cancellation fee.

4. Payment Terms

4.1 Pricing

Prices for our cleaning services are determined based on the specific requirements of each job, including the size of the space, type of cleaning needed, frequency of service, and any special requests. Prices are subject to change with reasonable notice to our clients.

4.2 Payment Methods

We accept various payment methods, including credit cards, debit cards, e-transfers, and pre-authorized payments for recurring services. Commercial clients may arrange invoicing with net-30 terms after approval.

4.3 Late Payments

For invoiced services, payment is due within 30 days of the invoice date unless otherwise specified. Late payments may incur additional fees or interest charges at a rate of 1.5% per month.

5. Service Guarantees and Quality Assurance

5.1 Satisfaction Guarantee

Pristine Clean is committed to providing high-quality cleaning services. If you are not completely satisfied with our work, please notify us within 24 hours, and we will return to address any overlooked areas at no additional cost.

5.2 Damage Policy

While our cleaners take the utmost care with your property, in the rare event that damage occurs as a direct result of our cleaning activities, we will take appropriate action to remedy the situation. This may include repair, replacement, or financial compensation as determined on a case-by-case basis.

To be eligible for our damage policy, you must report any damage within 24 hours of the cleaning service.

6. Client Responsibilities

To ensure the best possible cleaning results, clients are expected to:

  • Provide clear access to all areas that require cleaning
  • Secure or remove any valuable or fragile items before our arrival
  • Inform us of any special handling instructions for specific items or surfaces
  • Ensure that pets are secured or removed from areas being cleaned, if necessary
  • Provide a safe working environment for our cleaning staff

7. Service Limitations

Our standard cleaning services do not include:

  • Moving heavy furniture or appliances
  • Cleaning areas that pose safety risks to our staff
  • Handling hazardous materials or waste disposal beyond normal household trash
  • Cleaning of external windows above ground level
  • Extensive hoarding situations

Some of these services may be available for an additional fee or through specialized cleaning arrangements.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Pristine Clean and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pristine Clean.

9. Website Use

9.1 User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

9.2 Prohibited Activities

You agree not to use the Service:

  • In any way that violates any applicable federal, provincial, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm the Company or users of the Service

10. Limitation of Liability

In no event shall Pristine Clean, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content.

Pristine Clean's liability for damages of any kind arising from our services shall be limited to the amount paid by you for the specific cleaning service that gave rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Pristine Clean, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
